Chilean Court Invalidates Ruling In Villar Case; Grants Barrick Motion

An Appeals Court in Santiago, Chile, has unanimously declared a civil court ruling in the case of Rodolfo Villar against Barrick Gold null and void.

The previous lower court ruling of June 19, 2006 annulled a purchase agreement in which Villar agreed to sell Barrick mineral rights in the vicinity of the Company’s Pascua-Lama project. Villar’s claims are located outside of the project’s area of mineralization, which straddles the border between Chile and Argentina in the Andes mountains.

Following a full review of that decision, the Court of Appeals found procedural irregularities in the lower court ruling. As a result, the Court has granted Barrick’s request for dismissal, and the case will now be referred back to a lower court for a new decision.

The mining claims in question are not expected to affect the development of Barrick’s Pascua-Lama project because they are located entirely outside Pascua Lama’s area of mineralization, and overlap previous mining rights legally held by the Company. Moreover, Barrick owns the surface rights to the area, enabling it to proceed with construction at Pascua-Lama when it receives final sectoral/administrative permits and resolves outstanding fiscal matters.
